1. Scope and status

These terms apply to the aupair.family website and the AuPair Family app provided by Swisswise GmbH. Public availability and supported devices are shown in the relevant store listing. Features can differ between app versions.

2. What the platform does

AuPair Family helps au pairs and host families create profiles, discover one another, express interest and communicate after mutual interest or an accepted request. Swisswise GmbH is not a party to any employment, accommodation or au pair agreement made between users and does not issue visas, residence permits or work permits.

A match, profile, message or technical check is not a recommendation or guarantee of identity, suitability, character, availability, legality or a successful placement.

3. Eligibility and account responsibility

The current app is designed for users aged 16 or older. People under 16 may not create an account. If you are 16 or 17, or otherwise not legally an adult where you live, use the service only with the permission and appropriate supervision of a parent or legal guardian and where local law allows it.

Access to the app does not mean that a person is legally eligible for an au pair programme. Programmes and countries may require a higher minimum age, set a maximum age or impose other immigration, work and safeguarding conditions. Users and their guardians must check the rules that apply before making an arrangement.

Provide accurate, current information, keep access credentials confidential and use only your own account. Do not impersonate another person or create duplicate or misleading profiles.

4. User content, limited licence and conduct

You remain responsible for content you submit and retain your ownership rights in it. You must have the rights and permissions needed to upload it. The app asks users not to upload photos showing recognisable children’s faces. Do not post unnecessary sensitive information about children or any other person.

For as long as content is held in the service, you grant Swisswise GmbH a non-exclusive, worldwide and royalty-free licence limited to hosting, storing, backing up, technically adapting, displaying to the intended users, and reviewing or moderating that content to operate, secure and improve AuPair Family. This licence does not transfer ownership and ends when the content is deleted, except for limited backup, safety-report, dispute or legal retention described in the Privacy Policy.

  • No fraud, false offers, advance-payment demands, money-transfer schemes or requests for cryptocurrency.
  • No harassment, threats, stalking, grooming, sexual exploitation, trafficking, forced labour, discrimination or other unlawful or child-endangering content or conduct.
  • No scraping, unauthorised access, security circumvention or interference with the service.
  • Do not pressure, manipulate or coerce anyone to move a conversation off-platform, disclose sensitive documents, conceal an arrangement or make a payment.

5. Platform rights and third-party services

The AuPair Family software, design, brand, text and other service materials supplied by Swisswise GmbH are protected by intellectual-property law. Except where the law allows it, you may not copy, sell, reverse engineer, misuse the brand or create a competing dataset from the service. User content remains subject to the rights described above.

The app may rely on app stores, optional login providers, notification services, payment services or external links. Their own terms and privacy information apply when you choose or use them. Swisswise GmbH does not control third-party services, and availability of a third-party service is not guaranteed.

6. Your checks and official requirements

Interview the other party, use video calls, check references and documents independently, agree duties and conditions in writing, and take reasonable safety precautions before sharing sensitive data, paying money, travelling or meeting.

Matching does not replace advice from authorities or qualified professionals. Visa, immigration, residence, work, employment, contract, insurance, social-security, tax and child-safeguarding rules depend on the countries, nationalities and circumstances involved.

An au pair placement may require an officially recognised or licensed placement agency. This can be mandatory for certain cross-border arrangements, including some placements involving third-country nationals. Confirm the current requirements with the competent authorities before making an arrangement.

7. Safety controls and their limits

The app includes mutual-contact, warning, block and report controls. These tools can reduce unwanted contact and help surface concerns, but they cannot prevent every scam or harmful act.

The document-number step is a format and duplicate-use check only. It is not identity verification and does not prove that information or a profile is genuine.

8. Moderation, suspension and appeals

Swisswise GmbH may review reports, remove or restrict content, preserve relevant evidence, limit functions, suspend or close accounts where reasonably necessary to protect users or the service, address suspected misuse or illegal content, enforce these terms or comply with legal requirements. Urgent action may be taken before a review is complete where safety or law requires it.

Where reasonably possible and legally permitted, the affected user will be told the main reason for a restriction and how to request a review. To appeal a moderation decision, use the contact form and identify your message as an appeal. Notice or details may be limited where disclosure could endanger someone, compromise an investigation, facilitate abuse or violate the law.

Users can stop using the service and request account deletion. An appeal does not prevent a user from exercising any mandatory right or contacting a competent authority.

9. Availability and changes to the service

Swisswise GmbH may change, suspend or discontinue functions, including integrations supplied by third parties. Material changes affecting users will be communicated where required by law.

The service is provided subject to availability. Swisswise GmbH does not promise uninterrupted or error-free access, a particular match or the accuracy of user-provided information.

App or storefront availability does not mean that an au pair programme exists or that a specific placement, visa, residence permit or work arrangement is lawful. Users must check the official requirements for the host country, nationality and circumstances involved.

10. Responsibility, governing law and mandatory rights

Users remain responsible for their communications, meetings, travel, payments and private arrangements. To the extent permitted by law, Swisswise GmbH is not responsible for user-provided content, another user’s conduct or the outcome of an arrangement made outside the platform.

Nothing in these terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited. Mandatory rights under the law applicable to the user remain unaffected.

To the extent a choice of law is permitted, these terms are governed by the substantive law of Switzerland. Where legally permitted, the courts at the registered office of Swisswise GmbH have jurisdiction. This choice does not deprive consumers of mandatory protections or access to a competent court available under the law of their habitual residence.

11. Contact, effective version and languages

Questions about these terms can be sent using the contact form. For the website, the published version applies from the date shown above. For the app, the version presented when an account is created or a later version notified to the user applies from the stated effective date. Material changes will be communicated before they take effect where required by law.

The detailed terms are provided in English, German and French and are intended to state the same rules. The English text is the reference version if a translation differs, except where mandatory local law or language requirements provide otherwise. No language provision limits mandatory consumer rights.

12. Family subscriptions

Au pairs use AuPair Family for free. The current family offer is a weekly subscription, where available through the store. The store shows the price, currency, billing period and any introductory offer before you confirm a purchase. Prices can differ by storefront; no introductory offer is promised unless it is displayed for your purchase.

Subscriptions renew automatically unless cancelled through the store where you subscribed. Cancelling renewal and the end of paid access are separate: access follows the subscription status and paid-through date confirmed by the store. A refund, revocation or expiry can end paid access. Store billing terms and mandatory consumer rights remain applicable.

Use Restore Purchases in the app with the purchasing store account if you need to restore an eligible purchase. Deleting the app or an AuPair Family account does not itself cancel a store subscription. For Apple purchases: manage or cancel your subscription or request a refund. A refund request is not a guarantee of approval.

A subscription provides the available paid platform functions; it does not guarantee a match, placement, visa or agreement with another user.
